In the name of public health, governments all around the world <a target=\"_blank\" href=\"https:\/\/academic.oup.com\/jcs\/article-abstract\/64\/4\/641\/6825777\" rel=\"noreferrer noopener\">closed church doors and forbade in-person worship<\/a>. In some places, churches remained closed even when other establishments such as bicycle repair shops and cinemas were open for business (e.g. <a target=\"_blank\" href=\"https:\/\/catholicherald.co.uk\/scotlands-top-court-declares-worship-ban-unlawful\/\" rel=\"noreferrer noopener\">Scotland<\/a> and <a target=\"_blank\" href=\"https:\/\/adfinternational.org\/let-us-worship-geneva\/\" rel=\"noreferrer noopener\">Switzerland<\/a>).<\/p>\n\n\n\n<p id=\"viewer-cl41k\">While many may want to put the pandemic behind them, violations of human rights should be corrected, at the very least so we can prevent them from happening again. In the case of FoRB, the ECtHR now has the chance to do exactly that.<\/p>\n\n\n\n<p id=\"viewer-coudr\"><a target=\"_blank\" href=\"https:\/\/www.janfigel.eu\/aboutjf\" rel=\"noreferrer noopener\">J\u00e1n Fige\u013e<\/a>, the former Special Envoy for FoRB outside the EU (2016-2019), and a practicing Catholic, is <a target=\"_blank\" href=\"https:\/\/app.echr.coe.int\/SOP\/index.aspx?lg=en\" rel=\"noreferrer noopener\">challenging before the ECtHR<\/a> the COVID-19 related restrictions to religious worship imposed by his home country, Slovakia, starting from February 2021. I have the honour of <a target=\"_blank\" href=\"https:\/\/adfinternational.org\/religious-freedom-covid-ecthr\/\" rel=\"noreferrer noopener\">co-representing<\/a> Fige\u013e before the ECtHR in a potentially precedent setting case for how the 46 member states of the Council of Europe should deal with FoRB in times of public health crisis.<\/p>\n\n\n\n<p id=\"viewer-32fec\"><strong>Scope of the case<\/strong><\/p>\n\n\n\n<p id=\"viewer-42lp3\">During the second wave, Slovakia <a target=\"_blank\" href=\"https:\/\/www.covidlawlab.org\/item\/resolution-of-the-slovak-government-no-77-on-prolongation-of-the-state-emergency-49-2021\/\" rel=\"noreferrer noopener\">prolonged<\/a> its pandemic restrictions, banning religious services, except for baptisms and weddings with up to six people. The case centers on the 40-day prolonged blanket ban on religious worship (8 February-19 March 2021), which transpired amidst a longer period of previous restrictions.<\/p>\n\n\n\n<p id=\"viewer-edl2l\">The government of Slovakia contends there was no violation of FoRB because:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>individual worship was still possible. But such an argument is contradicted by international and European human rights law, which protect FoRB manifested <em>either alone or in community with others.<\/em><\/li>\n\n\n\n<li>\u201conline worship\u201d was available. This claim disregards the fact that this is \u201cbest viewed as an alternative to worship, rather than worship itself\u201d (Reverend Dr William J U Philip and Others, paras. 60-61), and that for some faiths, such as Judaism, religious celebrations cannot be filmed or livestreamed (Belgian Conseil d\u2019\u00c9tat arrr\u00eat n\u00b0 249.177).<\/li>\n<\/ul>\n\n\n\n<p id=\"viewer-3fr7a\"><strong>Proportionality test<\/strong><\/p>\n\n\n\n<p id=\"viewer-cgu4o\">The case rests on the ECtHR\u2019s analysis of proportionality and necessity, and the margin of appreciation Slovakia had at that particular time.<\/p>\n\n\n\n<p id=\"viewer-1m2vb\">At the start of the pandemic, due to the novelty and lack of knowledge about the virus, governments had a wider margin to curtail fundamental rights. This gradually shrank with increased scientific information. Freedom-restrictive measures that might have been deemed legitimate at the beginning of 2020were likely not proportionate and necessary in 2021 and 2022.<\/p>\n\n\n\n<p id=\"viewer-5qur\">In advancing a justification for restricting FoRB, the onus is on Slovakia to prove proportionality. In this case, the government\u2019s blanket ban on religious worship during the later stages of the pandemic, once more scientific evidence became available, was at best a \u201cuseful\u201d form of restrictions, though certainly not the<em> most<\/em> useful and \u201cnecessary\u201d.<\/p>\n\n\n\n<p id=\"viewer-hg86\">The government also must show that the ban was the least restrictive means available, which will be difficult in light of other options, such as social distancing within churches or other <a target=\"_blank\" href=\"https:\/\/www.who.int\/publications\/i\/item\/practical-considerations-and-recommendations-for-religious-leaders-and-faith-based-communities-in-the-context-of-covid-19\" rel=\"noreferrer noopener\">measures recommended by the WHO<\/a>.<\/p>\n\n\n\n<p id=\"viewer-5gmt6\"><strong>A precedent for FoRB at the ECtHR<\/strong><\/p>\n\n\n\n<p id=\"viewer-auvkf\">While the <a target=\"_blank\" href=\"https:\/\/academic.oup.com\/jcs\/article-abstract\/64\/4\/641\/6825777\" rel=\"noreferrer noopener\">ECtHR has dealt with applications<\/a> related to FoRB during the pandemic (such as <a target=\"_blank\" href=\"https:\/\/app.echr.coe.int\/SOP\/index.aspx?lg=en\" rel=\"noreferrer noopener\"><em>Magdi\u0107 v Croatia<\/em><\/a><em>, <\/em>which was declared inadmissible, or <a target=\"_blank\" href=\"https:\/\/hudoc.echr.coe.int\/fre#{%22tabview%22:[%22document%22],%22itemid%22:[%22002-13820%22]}\" rel=\"noreferrer noopener\"><em>Sp\u00eenu v Romania<\/em><\/a> in which no violation was found in the prison context), it has not yet ruled on the proportionality of bans on public worship, and certainly not with regards to the second wave of the pandemic. There are at least three noteworthy cases pending (<a target=\"_blank\" href=\"https:\/\/app.echr.coe.int\/SOP\/index.aspx?lg=en\" rel=\"noreferrer noopener\"><em>M\u00e9gard v France<\/em><\/a>, <a target=\"_blank\" href=\"https:\/\/app.echr.coe.int\/SOP\/index.aspx?lg=en\" rel=\"noreferrer noopener\"><em>Chiril\u0103 v Romania<\/em><\/a> and <a target=\"_blank\" href=\"https:\/\/app.echr.coe.int\/SOP\/index.aspx?lg=en\" rel=\"noreferrer noopener\"><em>Association d\u2019Ob\u00e9dience Eccl\u00e9siastique Orthodoxe c. Gr\u00e8ce <\/em><\/a>) and the timeline indicates that <em>Figel <\/em>may be the first case where the ECtHR will assess the proportionality of worship bans during COVID-19. Should the Court do so, it would take the symbolic opportunity to rule on the case of the former Special Envoy for FoRB, who has repeatedly <a target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=Egxd4w0Y5rQ\" rel=\"noreferrer noopener\">stated<\/a> that \u201cThe EU cannot credibly advance religious freedom throughout the world if its member states fail to uphold fundamental freedoms at home.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"79\" height=\"79\" src=\"https:\/\/janfigel.com\/wp-content\/uploads\/2025\/05\/7dce12_57f12bcfdd4c47008ff1c4006993cb30mv2.jpg\" alt=\"\" class=\"wp-image-15207\"\/><\/figure>\n\n\n\n<p id=\"viewer-3o2t3\"><a target=\"_blank\" href=\"https:\/\/ohrh.law.ox.ac.uk\/author\/adina-portaru\/\" rel=\"noreferrer noopener\">Adina Portaru<\/a><\/p>\n\n\n\n<p id=\"viewer-d9t95\">Adina Portaru serves as Senior Counsel for ADF International, where she focuses on freedom of religion or belief at the European Union and on litigation at the European Court of Human Rights.
