This is the question brought by former EU Special Envoy for Freedom of Religion or Belief, Dr. J\u00e1n Fige\u013e, who has filed a challenge at the European Court of Human Rights (ECtHR) on the 2021 COVID restrictions on public worship. Fige\u013e, co-represented by human rights organisation ADF International and local Slovak lawyer Martin Timcsak, now submitted his arguments to the court.<\/p>\n\n\n\n<p id=\"viewer-d8f3g\">\u201cReligious freedom as a basic human right deserves the highest level of protection. Prohibiting people from worship and communal religious exercise is profoundly illiberal and illegitimate. Worship bans were unfair and disproportionate. Our arguments submitted to the Court demonstrate clearly that blanket bans are violations of religious freedom under international human rights law,\u201d stated Dr. J\u00e1n Fige\u013e.<\/p>\n\n\n\n<p id=\"viewer-9fv2m\">Fige\u013e\u2019s case might be the first where Europe\u2019s top human rights court rules on the blanket bans on public worship during the Covid pandemic. The decision would set a precedent for 46 European States with 676 million citizens.<\/p>\n\n\n\n<p id=\"viewer-3h1d9\"><strong>\u201cIn times of crisis, fundamental freedoms need to be protected, rather than weakened.\u201d<\/strong><\/p>\n\n\n\n<p id=\"viewer-4h2s4\">In 2021 the Slovak Republic prolonged its COVID restrictions, banning religious services. Dr. J\u00e1n Fige\u013e and ADF International lead lawyer Dr. Adina Portaru argue that the restrictions violated both national and international law.<\/p>\n\n\n\n<p id=\"viewer-95jtl\">\u201cWe are committed to supporting Dr. J\u00e1n Fige\u013e and his defence of religious freedom. The international legal framework is very clear in its protection of this right as it benefits everyone \u2013 people of faith as well as people of no faith. Fundamental freedoms apply to all, and in times of crisis they must be protected rather than weakened,\u201d said Dr. Adina Portaru, Senior Counsel for ADF International.<\/p>\n\n\n\n<p id=\"viewer-fcu4u\"><strong>Individual or digital worship not sufficient<\/strong><\/p>\n\n\n\n<p id=\"viewer-4iqcm\">In the submitted arguments Fige\u013e\u2019s legal team highlights that religious freedom specifically includes the right to communal worship under the law. The Slovak government previously had argued that spirituality can be lived out individually. However, as the ECtHR has upheld repeatedly, freedom of religion specifically includes the <a target=\"_blank\" href=\"https:\/\/hudoc.echr.coe.int\/eng#{%22languageisocode%22:[%22ENG%22],%22appno%22:[%2231706\/10%22,%2233088\/10%22],%22documentcollectionid2%22:[%22CHAMBER%22],%22itemid%22:[%22001-148610%22]}\" rel=\"noreferrer noopener\">\u201cfreedom to manifest one\u2019s religion not only alone and in private but also in community with others, in public and within the circle of those whose faith one shares\u201d.\u202f<\/a><\/p>\n\n\n\n<p id=\"viewer-elmv3\">The Slovak government also put forward the option of digital worship as a justification for the blanket ban. Recent court rulings throughout Europe, however, arrive at different conclusions. Scotland\u2019s highest civil court ruled on the same issue, holding that digital options <a target=\"_blank\" href=\"https:\/\/www.scotcourts.gov.uk\/docs\/default-source\/cos-general-docs\/pdf-docs-for-opinions\/2021csoh032.pdf\" rel=\"noreferrer noopener\">\u201care best viewed as an alternative to worship, rather than worship itself\u201d.<\/a><\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Dr. J\u00e1n Figel\u2019 - Defending Religious Freedom in Europe\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/Egxd4w0Y5rQ?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p id=\"viewer-55tij\"><strong>Restrictions were not \u201cproportional, appropriate, and necessary\u201d<\/strong><\/p>\n\n\n\n<p id=\"viewer-84pd5\">The case rests on the fact that the Slovak blanket ban was neither proportional, nor appropriate or necessary.<\/p>\n\n\n\n<p id=\"viewer-87ijj\">\u201cNobody should be prohibited from peacefully exercising his or her convictions, and it was evident that religious worship could be conducted safely during the pandemic. Blanket bans ignore the central role that religion plays in the lives of believers. For people of faith, communal worship, spiritual nourishment, can be as important as bodily nourishment. That\u2019s why international and European law and our very own Constitution holds religious freedom so dearly. I expect that the ECtHR will consider this holistically with a keen eye for the role of human rights in a democratic society,\u201d said Dr. J\u00e1n Fige\u013e upon submitting the arguments.<\/p>\n\n\n\n<p id=\"viewer-fdl9b\"><strong>Former Special Envoy for Freedom of Religion now defends human rights at home<\/strong><\/p>\n\n\n\n<p id=\"viewer-bdfs5\">J\u00e1n Fige\u013e served as European Commissioner in various positions between 2004 and 2009. In 2016 he was appointed as Special Envoy for Freedom of Religion or Belief outside the EU, a position he held until 2019.<\/p>\n\n\n\n<p id=\"viewer-3ui3o\">\u201cAs Special Envoy, it was evident to me that the EU cannot credibly advance religious freedom throughout the world if its Member States fail to uphold fundamental freedoms at home,\u201d Fige\u013e added.<\/p>\n\n\n\n<p id=\"viewer-e1qg4\">A newly released video features Dr. J\u00e1n Fige\u013e and ADF International lead lawyer Dr. Adina Portaru in Bratislava\/Slovakia.<\/p>\n\n\n\n<p id=\"viewer-333d9\"><strong>Worldwide advocacy for religious freedom<\/strong><\/p>\n\n\n\n<p id=\"viewer-ntmr\">Fige\u013e\u2019s challenge has been backed by a <a target=\"_blank\" href=\"https:\/\/www.tkkbs.sk\/view.php?cisloclanku=20210322041\" rel=\"noreferrer noopener\">civil society coalition of diverse representatives<\/a> from the arts, academia, and politics with different faith backgrounds. <a target=\"_blank\" href=\"https:\/\/www.tkkbs.sk\/view.php?cisloclanku=20210322036\" rel=\"noreferrer noopener\">Bishops<\/a> and other faith leaders also have welcomed his case.<\/p>\n\n\n\n<p id=\"viewer-e4cm5\">ADF International has been involved worldwide in cases regarding worship bans and violations of religious freedom in the context of Covid restrictions. In Uganda, the organisation supported a coalition of Christians and Muslims challenging a discriminatory prohibition of religious gatherings.
