The&nbsp;<a href=\"https:\/\/unificationnews.eu\/family-federation\/\">organization<\/a>&nbsp;immediately&nbsp;<a href=\"https:\/\/unificationnews.eu\/ffwpu-files-appeal-citing-speculative-verdict\/\">filed an appeal<\/a>, and the case is now under review at the&nbsp;<em>Tokyo High Court<\/em>. J\u00e1n Figel, Former Slovak Deputy Prime Minister and former&nbsp;<em>EU Special Envoy for Freedom of Religion<\/em>, recently gave an interview to&nbsp;<a href=\"https:\/\/www.worldtimes.co.jp\/\" target=\"_blank\" rel=\"noreferrer noopener\">this paper<\/a>, discussing the problems with the decision and the significance of religious freedom.<\/p>\n\n\n\n<p><em>Interview by: Yosuke Yamazaki (\u5c71\u5d0e \u6d0b\u4ecb), the Washington office of the&nbsp;<a href=\"https:\/\/www.worldtimes.co.jp\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sekai Nippo<\/a><\/em><\/p>\n\n\n\n<p><strong>\u2013 On 25<sup>th<\/sup>&nbsp;March, the Tokyo District Court issued a dissolution order against the&nbsp;<a href=\"https:\/\/unificationnews.eu\/family-federation\/\">Family Federation<\/a>. What are your thoughts on this decision?<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image alignleft\"><img decoding=\"async\" src=\"https:\/\/unificationnews.eu\/wp-content\/uploads\/2024\/10\/ICCPR.jpg\" alt=\"ICCPR\" class=\"wp-image-9983\"\/><\/figure>\n\n\n\n<p>I have serious concerns. This&nbsp;<a href=\"https:\/\/unificationnews.eu\/certain-appeal-unprecedented-dissolution-order\/\">dissolution order<\/a>&nbsp;lacks constitutional legal grounds and clearly violates the&nbsp;<a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/international-covenant-civil-and-political-rights\" target=\"_blank\" rel=\"noreferrer noopener\"><em>International Covenant on Civil and Political Rights<\/em><\/a>, to which Japan is a signatory.<\/p>\n\n\n\n<p>Such measures can pose a threat to minority religions and faith communities. When one minority group is treated unfairly, others are endangered as well.<\/p>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/unificationnews.eu\/certain-appeal-unprecedented-dissolution-order\/\">decision<\/a>&nbsp;against the&nbsp;<a href=\"https:\/\/unificationnews.eu\/family-federation\/\">Family Federation<\/a>&nbsp;is based on false evidence and accusations, lacking substantive grounds. It was motivated not by law, but by political considerations.<\/p>\n\n\n\n<p><strong>\u2013 What do you see as particularly problematic about this decision?<\/strong><\/p>\n\n\n\n<p>The&nbsp;<em>Tokyo District Court<\/em>\u2019s&nbsp;<a href=\"https:\/\/unificationnews.eu\/certain-appeal-unprecedented-dissolution-order\/\">ruling<\/a>&nbsp;is arbitrary, clearly unconstitutional, and unlawful. It lacks due process in several respects. First, the hearings were held behind closed doors.<\/p>\n\n\n\n<figure class=\"wp-block-image\" id=\"attachment_4388\"><img decoding=\"async\" src=\"https:\/\/unificationnews.eu\/wp-content\/uploads\/2023\/10\/Religious-Corporations-Act-Japan-eng.jpg\" alt=\"Religious Corporations Act of Japan\" class=\"wp-image-4388\"\/><figcaption class=\"wp-element-caption\"><em>Front page of 2018 English version of Religious Corporations Act of Japan.<\/em><\/figcaption><\/figure>\n\n\n\n<p>Furthermore, Article 81 of the&nbsp;<em>Religious Corporations Act<\/em>&nbsp;allows the government to request dissolution only if a religious corporation has committed acts that \u201cviolate laws and regulations and are clearly deemed to harm the public welfare to a serious extent.\u201d The court broadened this interpretation to include 32 civil tort cases involving former members over a span of 40 years. The&nbsp;<em>Ministry of Education<\/em>&nbsp;(MEXT) suddenly reinterpreted the law to justify the dissolution request, regarding it as a serious infringement on public welfare.<\/p>\n\n\n\n<p>The court judged that the&nbsp;<a href=\"https:\/\/unificationnews.eu\/family-federation\/\"><em>Family Federation<\/em><\/a>\u2019s missionary work and solicitation of donations violated \u201csocial appropriateness and social norms,\u201d but these concepts are so vague that they invite arbitrary administrative and judicial application.<\/p>\n\n\n\n<figure class=\"wp-block-image\" id=\"attachment_9576\"><img decoding=\"async\" src=\"https:\/\/unificationnews.eu\/wp-content\/uploads\/2024\/09\/UN-Human-Rights-Committee.jpg\" alt=\"UN Human Rights Committee\" class=\"wp-image-9576\"\/><figcaption class=\"wp-element-caption\"><em>From header of the&nbsp;<a href=\"https:\/\/www.ohchr.org\/en\/treaty-bodies\/ccpr\" target=\"_blank\" rel=\"noreferrer noopener\">webpage<\/a>&nbsp;of the Human Rights Committee, a subpage on the site of the UN Human Rights Office of the High Commissioner<\/em><\/figcaption><\/figure>\n\n\n\n<p>The&nbsp;<em>UN Human Rights Committee<\/em>&nbsp;has advised Japan to stop using \u201cpublic welfare\u201d as a justification for restricting religious freedom. Article 18 of the&nbsp;<a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/international-covenant-civil-and-political-rights\" target=\"_blank\" rel=\"noreferrer noopener\"><em>International<\/em>&nbsp;<em>Covenant on Civil and Political Rights<\/em><\/a>&nbsp;does not recognize such restrictions. In fact, according to the Committee, states have an obligation to protect minority religions that may be targeted by hostility from dominant religious groups.<\/p>\n\n\n\n<p>Yet Japan has ignored this and even tolerated coercive faith-breaking carried out by Protestant pastors. It has been revealed that many plaintiffs against the&nbsp;<a href=\"https:\/\/unificationnews.eu\/family-federation\/\"><em>Family Federation<\/em><\/a>&nbsp;were subjected to deprogramming (coercive faith-breaking)&nbsp;[See editor\u2019s note below]&nbsp;and&nbsp;<a href=\"https:\/\/unificationnews.eu\/japan-4300-abductions-and-forcible-detentions\/\">confinement<\/a>.<\/p>\n\n\n\n<p>The&nbsp;<em>Tokyo District Court<\/em>&nbsp;also adopted the unscientific \u201cmind control theory\u201d and based its judgment on hypothetical potential victims. This demonstrates arbitrary and biased decision-making. Legitimate court rulings must not be swayed by political pressure or media campaigns. Cropped<\/em><\/figcaption><\/figure>\n\n\n\n<p>At the root of the conflict between the&nbsp;<em>Japanese Communist Party<\/em>&nbsp;and the&nbsp;<a href=\"https:\/\/unificationnews.eu\/family-federation\/\"><em>Family Federation<\/em><\/a>&nbsp;lies Marxist atheism. This ideology often turns into a radical movement that seeks to exclude belief in&nbsp;<a href=\"https:\/\/unificationnews.eu\/god\/\">God<\/a>&nbsp;and ban religion altogether. Religion liberates believers from worship of secular values and authoritarian state power, enabling believers to live independently, which is why authoritarian systems oppose it.<\/p>\n\n\n\n<p>I spent half my life under the communist regime in Czechoslovakia. My uncle was killed by the regime\u2019s secret police. The system sought to suppress all religions, both traditional and new, through various coercive means. But ultimately it was defeated, collapsing peacefully in 1989. Photo:&nbsp;<a href=\"https:\/\/www.worldtimes.co.jp\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sekai Nippo<\/a><\/em><\/p>\n\n\n\n<p>[<em><strong>Editor\u2019s note<\/strong><\/em>:&nbsp;<strong>Coercive faith-breaking<\/strong>&nbsp;(\u201cdeprogramming\u201d) in Japan refers to the practice of coercively attempting to separate individuals from their religious affiliations or beliefs, typically through intervention by family members, professional faith-breakers (deprogrammers) or organizations hostile to new religious movements (NRMs). This phenomenon often targets members of such movements, e.g. relatively large faiths like the&nbsp;<a href=\"https:\/\/unificationnews.eu\/family-federation\/\">Family Federation<\/a>&nbsp;or Jehovah\u2019s Witnesses, but also smaller groups like Happy Science (K\u014dfuku no Kagaku) and other newer religious movements.<\/p>\n\n\n\n<figure class=\"wp-block-image\" id=\"attachment_13280\"><img decoding=\"async\" src=\"https:\/\/unificationnews.eu\/wp-content\/uploads\/2025\/04\/Soka_Gakkai_Students-cropped.jpg\" alt=\"Soka Gakkai students\" class=\"wp-image-13280\"\/><figcaption class=\"wp-element-caption\"><em><strong>Also subject to faith-breaking attempts<\/strong>: Members of&nbsp;<strong>Soka Gakkai<\/strong>. Cropped<\/em><\/figcaption><\/figure>\n\n\n\n<p>However, also Soka Gakkai, a Buddhist-based lay organization with more than 8 million Japanese members, and affiliated with Nichiren Buddhism, has occasionally been subject to faith-breaking attempts.<\/p>\n\n\n\n<p>The practice gained attention in the latter half of the 20th century, particularly in the 1980s and 1990s. Parents or concerned family members often hired faith-breakers who taught them how to abduct and forcibly detain believers. Almost all such cases involved confining the individual believer and cutting him or her off from the religious community. During the confinement, the believer was subjected to intense questioning or indoctrination designed to break his or her faith. The aim was to \u201crescue\u201d the person from what the family often had been tricked by faith-breakers or lawyers to regard as harmful influence from the religious organization.<\/p>\n\n\n\n<p>Critics of forced de-conversion argue that it violates fundamental human rights, including freedom of thought, religion, and association. Reports of psychological trauma and accusations of unlawful detention have sparked debates over its ethical and legal implications. In response, some religious groups, particularly NRMs, have lobbied for greater protections against such practices.<\/p>\n\n\n\n<p>Japanese courts have been inconsistent in addressing cases of coercive faith-breaking.
