Tento proces<br>nie je priamo\u010diary a bezprobl\u00e9mov\u00fd, ale som presved\u010den\u00fd, \u017ee napriek<br>\u0165a\u017ekostiam a h\u013eadaniam (ba pr\u00e1ve preto) postupuj\u00faci dopredu. Tento<br>proces reaguje na v\u00fdzvy zvn\u00fatra i zvonka \u00danie. Po viac ako dvoch<br>rokoch od negat\u00edvnych referend vo Franc\u00fazsku a Holandsku sa \u00danii<br>podarilo prekona\u0165 hrozbu in\u0161titucion\u00e1lnej kr\u00edzy:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>do\u0161lo k dohode o<br>novej reformnej zmluve.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>R\u00e1d by som na tomto mieste vyslovil uznanie nemeck\u00e9mu i<br>portugalsk\u00e9mu predsedn\u00edctvu E\u00da za efekt\u00edvne vedenie rokovan\u00ed o<br>reformnej (Lisabonskej) zmluve, ktor\u00fdmi 27 \u0161t\u00e1tov dospelo k novej<br>dohode o reforme E\u00da. Rozsah zmien a v\u00fdznam Lisabonskej zmluvy<br>podstatne presahuje v\u00fdznam zmien z Amsterdamu a z Nice. D\u00e1 sa<br>prirovna\u0165 k zmene z Maastrichtu, ktorou bola E\u00da ustanoven\u00e1 a ktor\u00e1<br>priniesla aj in\u00e9 prelomov\u00e9 rozhodnutia (napr. vytvorenie ekonomickej<br>a menovej \u00fanie).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Nevyhnutnos\u0165 prijatia Reformnej zmluvy vych\u00e1dza z viacn\u00e1sobnej<br>potreby adapt\u00e1cie s\u00fa\u010dasnej E\u00da. U\u017e Laekensk\u00e1 deklar\u00e1cia po prijat\u00ed<br>minim\u00e1lnych \u00faprav zmluvou z Nice postulovala v r. 2001 potrebu zv\u00fd\u0161i\u0165<br>demokratickos\u0165, transparentnos\u0165 a efekt\u00edvnos\u0165 vtedy 15-\u010dlennej \u00danie<br>pripravuj\u00facej sa na najv\u00e4\u010d\u0161ie roz\u0161\u00edrenie. V globalizuj\u00facom sa<br>medzin\u00e1rodnom prostred\u00ed rastie tie\u017e v\u00fdzva kona\u0165 \u00fa\u010dinne a akt\u00edvne<br>v s\u00falade s potrebami eur\u00f3pskych ob\u010danov a \u0161t\u00e1tov v 21. storo\u010d\u00ed. Reforma<br>in\u0161tit\u00faci\u00ed \u00danie je potrebn\u00e1 nielen kv\u00f4li \u010fal\u0161iemu roz\u0161irovaniu \u00danie, ale<br>tie\u017e kv\u00f4li lep\u0161iemu vyu\u017eitiu potenci\u00e1lu E\u00da. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zjednodu\u0161en\u00edm rozhodovac\u00edch mechanizmov<br>nov\u00e1 zmluva potenci\u00e1lne zvy\u0161uje<br>\u00fa\u010dinnos\u0165 in\u0161tit\u00faci\u00ed a rozhodnut\u00ed \u00danie<br>, najm\u00e4 so zrete\u013eom na nov\u00e9<br>v\u00fdzvy, napr\u00edklad globaliz\u00e1ciu, klimatick\u00e9 zmeny, energetick\u00fa bezpe\u010dnos\u0165,<br>medzin\u00e1rodn\u00fd terorizmus, medzin\u00e1rodn\u00fd organizovan\u00fd zlo\u010din,<br>pris\u0165ahovalectvo a \u010fal\u0161ie roz\u0161irovanie \u00danie. Zmluva taktie\u017e zv\u00fd\u0161i v\u00e1hu<br>Eur\u00f3pskeho parlamentu i n\u00e1rodn\u00fdch parlamentov v rozhodovac\u00edch<br>procesoch, \u010do napokon umo\u017en\u00ed dosiahnu\u0165 v\u00e4\u010d\u0161iu s\u00fadr\u017enos\u0165. Podpis<br>zmluvy 13. decembra 2007 otvor\u00ed cestu k ratifika\u010dn\u00e9mu procesu, ktor\u00fd si<br>vy\u017eaduje obdobn\u00fa zodpovednos\u0165, ako doteraj\u0161\u00ed rokovac\u00ed proces. Pozna\u0165<br>a rozumie\u0165 navrhovan\u00fdm zmen\u00e1m zo strany dec\u00edznej sf\u00e9ry a ob\u010danov<br>m\u00e1 pre v\u00fdsledok tohoto procesu rozhoduj\u00faci v\u00fdznam. \u010casov\u00fdm<br>horizontom ratifik\u00e1cie je 1. janu\u00e1r 2009, tak aby sa nasleduj\u00face vo\u013eby do<br>EP v j\u00fani 2009 uskuto\u010dnili pod\u013ea nov\u00fdch pravidiel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>V mojom kr\u00e1tkom pr\u00edspevku nechcem a ani nem\u00f4\u017eem \u00eds\u0165 do detailov.<br>Predsa si v\u0161ak dovol\u00edm zhrn\u00fa\u0165 najd\u00f4le\u017eitej\u0161ie zmeny z h\u013eadiska<br>in\u0161titucion\u00e1lneho fungovania E\u00da.<br>Z\u00e1kladn\u00e9 obsahov\u00e9 zmeny v doteraj\u0161om fungovan\u00ed E\u00da<br>Doch\u00e1dza k nahradeniu \u00danie a Eur\u00f3pskeho spolo\u010denstva jedn\u00fdm<br>n\u00e1zvom:<strong> Eur\u00f3pska \u00fania<\/strong>. \u00dania z\u00edska v\u00fdlu\u010dn\u00fa pr\u00e1vnu subjektivitu<br>D\u00f4sledkom toho iba E\u00da bude opr\u00e1vnen\u00e1 uzatv\u00e1ra\u0165 medzin\u00e1rodn\u00e9<br>zmluvy v oblastiach, v ktor\u00fdch m\u00e1 p\u00f4sobnos\u0165. Reformn\u00e1 zmluva men\u00ed<br><br>a dop\u013a\u0148a Zmluvu o Eur\u00f3pskej \u00fanii (Zmluva o E\u00da) a Zmluvu o zalo\u017een\u00ed<br>Eur\u00f3pskeho spolo\u010denstva, ktor\u00e1 sa premenuje na Zmluvu o fungovan\u00ed<br>Eur\u00f3pskej \u00fanie (ZFE\u00da). Obe zmluvy bud\u00fa ma\u0165 rovnak\u00fa pr\u00e1vnu silu, nov\u00e1<br>zmluva nem\u00e1 \u00fastavn\u00fa povahu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>V podstate zanikne pilierov\u00e9 usporiadanie, tri piliere sa zlu\u010duj\u00fa, tak\u017ee<br>spolo\u010dn\u00e9 politiky v oblasti slobody, bezpe\u010dnosti a spravodlivosti<br>sa<br>bud\u00fa v z\u00e1sade tie\u017e riadi\u0165 komunit\u00e1rnou met\u00f3dou rozhodovania.<br>Spolo\u010dn\u00e1 zahrani\u010dn\u00e1 a bezpe\u010dnostn\u00e1 politika<br>vr\u00e1tane obrannej<br>politiky zost\u00e1va v\u0161ak upraven\u00e1 osobitne v Zmluve o E\u00da (zatia\u013e \u010do in\u00e9<br>oblasti vonkaj\u0161ej \u010dinnosti E\u00da rie\u0161i ZFE\u00da) a aj na\u010falej sa na \u0148u bud\u00fa<br>vz\u0165ahova\u0165 osobitn\u00e9 pravidl\u00e1 a rozhodovacie postupy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>V\u00fdznamnej\u0161\u00ed d\u00f4raz sa kladie na hodnoty a ciele<br>\u00danie v prv\u00fdch dvoch<br>\u010dl\u00e1nkoch Zmluvy. Dodr\u017eiavanie t\u00fdchto hodn\u00f4t bude tvori\u0165 r\u00e1mec pre<br>posudzovanie bud\u00faceho roz\u0161irovania \u00danie<br>ako aj pre mo\u017en\u00e9 sankcie<br>vo\u010di \u010dlensk\u00fdm krajin\u00e1m, ktor\u00e9 by ich trvalo poru\u0161ovali.<br>\u010cl\u00e1nok 6 Zmluvy potvrdil prist\u00fapenie \u00danie ku Eur\u00f3pskemu<br>dohovoru o \u013eudsk\u00fdch pr\u00e1vach<br>.<br>Charta z\u00e1kladn\u00fdch pr\u00e1v<br>sa st\u00e1va<br>pr\u00e1vne z\u00e1v\u00e4znou a bude ma\u0165 rovnak\u00fa pr\u00e1vnu silu ako zmluvy, hoci jej<br>text nebude tvori\u0165 s\u00fa\u010das\u0165 Zml\u00fav. Chartu sl\u00e1vnostne vyhl\u00e1sia predsedovia<br>Parlamentu, Rady a Komisie na plen\u00e1rnej sch\u00f4dzi Parlamentu 12.<br>decembra 2007. Protokolom sa zav\u00e1dzaj\u00fa osobitn\u00e9 opatrenia a v\u00fdnimky<br>pre Spojen\u00e9 kr\u00e1\u013eovstvo a Po\u013esko, ktor\u00e9 sa t\u00fdkaj\u00fa jurisdikcie Eur\u00f3pskeho<br>s\u00fadneho dvora a vn\u00fatro\u0161t\u00e1tnych s\u00fadov na ochranu pr\u00e1v uznan\u00fdch<br>Chartou.<br>Ustanovenia t\u00fdkaj\u00face sa ob\u010dianstva<br>bud\u00fa s\u00fa\u010das\u0165ou ZFE\u00da,<br>koncepcia eur\u00f3pskeho ob\u010dianstva sa posilnila v \u010dl\u00e1nku 8 Zmluvy o E\u00da:<br>\u201eKa\u017ed\u00e1 osoba, ktor\u00e1 m\u00e1 \u0161t\u00e1tnu pr\u00edslu\u0161nos\u0165 niektor\u00e9ho \u010dlensk\u00e9ho \u0161t\u00e1tu, je<br>ob\u010danom \u00danie. Ob\u010dianstvo \u00danie dop\u013a\u0148a \u0161t\u00e1tne ob\u010dianstvo, ale<br>nenahr\u00e1dza ho.\u201d<br>V Zmluve sa zakotvuj\u00fa ur\u010dit\u00e9 z\u00e1kladn\u00e9 princ\u00edpy<br>vz\u0165ahy medzi \u00daniou a \u010dlensk\u00fdmi krajinami<br>a upravuj\u00fa sa<br>(rozdelenie kompetenci\u00ed,<br>spolupr\u00e1ca, rovnos\u0165 \u010dlensk\u00fdch kraj\u00edn). Ako v\u00fdsledok j\u00fanov\u00e9ho<br>kompromisu sa do Zmluvy za\u010dlenil aj \u010dl\u00e1nok o n\u00e1rodnej bezpe\u010dnosti<br>,<br>ktor\u00e1 zost\u00e1va vo v\u00fdlu\u010dnej p\u00f4sobnosti ka\u017ed\u00e9ho \u010dlensk\u00e9ho \u0161t\u00e1tu.<br>V Zmluve je definovan\u00e1 mo\u017enos\u0165 vyst\u00fapenia z \u00danie<br>. Vyst\u00fapenie z<br>\u00danie nie je podmie\u0148ovan\u00e9 dodato\u010dn\u00fdmi podmienkami a nadobudne<br>platnos\u0165 po uzatvoren\u00ed dohody medzi \u00daniou a pr\u00edslu\u0161n\u00fdm \u010dlensk\u00fdm<br>\u0161t\u00e1tom, resp. po dvoch rokoch od podania \u017eiadosti.<br>In\u0161titucion\u00e1lny r\u00e1mec<br>Eur\u00f3pska rada je nov\u00e1 in\u0161tit\u00facia, odli\u0161n\u00e1 od Rady. Nov\u00fd st\u00e1ly<br>predseda Eur\u00f3pskej rady<br>(volen\u00fd na dva a pol roka hlavami \u0161t\u00e1tov a<br>vl\u00e1d kvalifikovanou v\u00e4\u010d\u0161inou) bude predseda\u0165 Eur\u00f3pskej rade a riadi\u0165 jej<br>\u010dinnos\u0165. Na rozdiel od s\u00fa\u010dasn\u00e9ho predsedu ER, nebude ma\u0165 n\u00e1rodn\u00fd<br>mand\u00e1t. Bude zabezpe\u010dova\u0165 pr\u00edpravu a kontinuitu \u010dinnosti Eur\u00f3pskej<br>rady, bude sa podporova\u0165 s\u00fadr\u017enos\u0165 a usilova\u0165 o konsenzus v r\u00e1mci<br>Eur\u00f3pskej rady a po ka\u017edej jej sch\u00f4dzi bude predklada\u0165 spr\u00e1vu<br>Eur\u00f3pskemu parlamentu.<br>Modifikuje sa po\u010det poslancov Eur\u00f3pskeho parlamentu<br>od r. 2009<br>na 751 (750 plus predseda EP). Po\u010det poslancov za ka\u017ed\u00fa krajinu bude<br>stanoven\u00fd na z\u00e1klade proporcion\u00e1lneho degres\u00edvneho krit\u00e9ria medzi<br>minim\u00e1lnym po\u010dtom 6 poslancov a maxim\u00e1lnym po\u010dtom 96. O<br>definit\u00edvnom rozdelen\u00ed po\u010dtov poslancov rozhodne jednomyse\u013ene<br>Eur\u00f3pska rada. Z\u00e1rove\u0148 sa posil\u0148uj\u00fa pr\u00e1vomoci EP<br>v oblasti<br>legislat\u00edvy<br>(spolurozhodovanie sa stane \u0161tandardnou legislat\u00edvnou<br>proced\u00farou), rozpo\u010dtu<br>(s\u00fahlas s viacro\u010dnou finan\u010dnou perspekt\u00edvou) a v<br>oblasti medzin\u00e1rodn\u00fdch zml\u00fav<br>(s\u00fahlas so v\u0161etk\u00fdmi dohodami, ktor\u00e9<br>zah\u0155\u0148aj\u00fa spolurozhodovanie).<br>Po\u010det \u010dlenov Komisie<br>sa od r. 2014 stanov\u00ed vo v\u00fd\u0161ke 2\/3 po\u010dtu<br>\u010dlensk\u00fdch kraj\u00edn, na z\u00e1klade princ\u00edpu rovnakej rot\u00e1cie zabezpe\u010duj\u00facej<br>ka\u017edej krajine \u010dlena Komisie v dvoch z 3 mand\u00e1tov. Po\u010det \u010dlenov<br>Komisie m\u00f4\u017ee by\u0165 modifikovan\u00fd jednomyse\u013en\u00fdm s\u00fahlasom Eur\u00f3pskej<br>rady. A\u017e do roku 2014 bude ma\u0165 teda ka\u017ed\u00e1 krajina jedn\u00e9ho \u010dlena<br>Komisie, vr\u00e1tane podpredsedu Komisie \u2013 Vysok\u00e9ho predstavite\u013ea pre<br>zahrani\u010dn\u00fa politiku. Posil\u0148uj\u00fa sa pr\u00e1vomoci predsedu Komisie, nako\u013eko<br>bude ma\u017e pr\u00e1vo odvola\u0165 \u010dlena Komisie. Predsedu Komisie bude voli\u0165<br>Eur\u00f3psky parlament v\u00e4\u010d\u0161inou v\u0161etk\u00fdch poslancov. Kandid\u00e1ta navrhne<br>Parlamentu po pr\u00edslu\u0161n\u00fdch konzult\u00e1ci\u00e1ch Eur\u00f3pska rada, ktor\u00e1 bude<br>menova\u0165 kandid\u00e1ta na z\u00e1klade rozhodnutia kvalifikovanou v\u00e4\u010d\u0161inou,<br>pri\u010dom vezme do \u00favahy v\u00fdsledky volieb do Eur\u00f3pskeho parlamentu.<br>Zmluva predpoklad\u00e1 posilnenie funkci\u00ed Vysok\u00e9ho predstavite\u013ea pre<br>zahrani\u010dn\u00fa politiku<br>, ktor\u00fd bude menovan\u00fd Eur\u00f3pskou radou<br>kvalifikovanou v\u00e4\u010d\u0161inou so s\u00fahlasom predsedu Komisie. Nov\u00fd Vysok\u00fd<br>predstavite\u013e bude zodpovedn\u00fd za spolo\u010dn\u00fa zahrani\u010dn\u00fa a bezpe\u010dnostn\u00fa<br>politiku. Za t\u00fdmto \u00fa\u010delom bude predseda\u0165 Rade pre zahrani\u010dn\u00e9<br>z\u00e1le\u017eitosti, a z\u00e1rove\u0148 bude aj podpredsedom Komisie a v tejto svojej<br>funkcii bude zodpovedn\u00fd za koordin\u00e1ciu zahrani\u010dn\u00fdch aktiv\u00edt v r\u00e1mci<br>Komisie.<br>Lisabonsk\u00e1 zmluva zav\u00e1dza nov\u00fd mechanizmus participat\u00edvnej<br>demokracie<br>, najm\u00e4 prostredn\u00edctvom pr\u00e1va ob\u010dianskej iniciat\u00edvy, ktor\u00e1<br>umo\u017e\u0148uje, aby aspo\u0148 mili\u00f3n ob\u010danov z v\u00fdznamn\u00e9ho po\u010dtu \u010dlensk\u00fdch<br>\u0161t\u00e1tov po\u017eiadal Komisiu o predlo\u017eenie iniciat\u00edvy v ur\u010ditej oblasti.<br><br>Nov\u00fd \u010dl\u00e1nok t\u00fdkaj\u00faci sa n\u00e1rodn\u00fdch parlamentov jasne definuje pr\u00e1va<br>a povinnosti n\u00e1rodn\u00fdch parlamentov, \u010di u\u017e ide o kontrolu subsidiarity,<br>alebo hodnotiaci mechanizmus v r\u00e1mci priestoru bezpe\u010dnosti,<br>spravodlivosti a slobody ako aj t\u00fdkaj\u00face sa zmien Zml\u00fav.<br>Doch\u00e1dza k v\u00fdrazn\u00e9mu posilneniu n\u00e1rodn\u00fdch parlamentov<br>kontrole uplat\u0148ovania princ\u00edpu subsidiarity a proporcionality<br>pri najm\u00e4 vo<br>f\u00e1ze programovania a pri predkladan\u00ed legislat\u00edvnych n\u00e1vrhov. Ka\u017ed\u00fd<br>n\u00e1rodn\u00fd parlament bude m\u00f4c\u0165 v r\u00e1mci 8 t\u00fd\u017ed\u0148ov od podania<br>legislat\u00edvneho n\u00e1vrhu predlo\u017ei\u0165 stanovisko, v ktorom zd\u00f4vodn\u00ed pre\u010do<br>pod\u013ea neho n\u00e1vrh nezodpoved\u00e1 resp. nere\u0161pektuje princ\u00edp subsidiarity.<br>Ak tak\u00e9to stanovisko bude reprezentova\u0165 minim\u00e1lne tretinu hlasov<br>pridelen\u00fdch n\u00e1rodn\u00fdm parlamentom, predkladate\u013e n\u00e1vrhu sa bude<br>musie\u0165 zaobera\u0165 rev\u00edziou textu, pri\u010dom v kone\u010dnom d\u00f4sledku<br>predkladate\u013e rozhodne \u010di n\u00e1vrh ponech\u00e1, uprav\u00ed alebo stiahne.<br>Okrem tohto postupu tzv. \u017eltej karty (ak legislat\u00edvny n\u00e1vrh odmietne<br>jedna tretina n\u00e1rodn\u00fdch parlamentov), sa zav\u00e1dza \u010fal\u0161\u00ed mechanizmus<br>(tzv. \u010derven\u00e1 karta) pri dohliadan\u00ed na uplat\u0148ovanie z\u00e1sady subsidiarity:<br>ak n\u00e1rodn\u00e9 parlamenty prijm\u00fa jednoduchou v\u00e4\u010d\u0161inou<br>stanovisko,<br>pod\u013ea ktor\u00e9ho legislat\u00edvny n\u00e1vrh nie je v s\u00falade so z\u00e1sadou subsidiarity,<br>a Rada alebo Parlament s\u00fahlas\u00ed s t\u00fdmto stanoviskom n\u00e1rodn\u00fdch<br>parlamentov, n\u00e1vrh sa zamieta.<br>V ostatn\u00fdch in\u0161tit\u00faci\u00e1ch sa v\u00fdrazn\u00e9 zmeny neuskuto\u010dnili. Posil\u0148uje sa<br>v\u0161ak p\u00f4sobnos\u0165 S\u00fadneho dvora<br>z d\u00f4vodu komunitariz\u00e1cie ur\u010dit\u00fdch<br>oblast\u00ed, napr. v oblasti s\u00fadnej spolupr\u00e1ce v trestn\u00fdch veciach a policajnej<br>spolupr\u00e1ce. Eur\u00f3pska centr\u00e1lna banka a Dvor aud\u00edtorov<br>sa zahrnuli do<br>In\u0161tit\u00faci\u00ed E\u00da. ECB si v\u0161ak ponech\u00e1va svoju pr\u00e1vnu subjektivitu a<br>nez\u00e1vislos\u0165 vo vz\u0165ahu k ostatn\u00fdm in\u0161tit\u00faci\u00e1m E\u00da.<br><br>Rovnako doch\u00e1dza k minim\u00e1lnym zmen\u00e1m vo fungovan\u00ed Rady<br>ministrov. Predov\u0161etk\u00fdm sa nemen\u00ed princ\u00edp polro\u010dn\u00fdch predsedn\u00edctiev.<br>V\u0161etky ostatn\u00e9 Rady okrem Rady pre zahrani\u010dn\u00e9 z\u00e1le\u017eitosti, ktorej bude<br>predseda\u0165 Vysok\u00fd predstavite\u013e, bud\u00fa riaden\u00e9 \u010dlensk\u00fdmi krajinami na<br>z\u00e1klade rovnocennej rot\u00e1cie \u010dlensk\u00fdch kraj\u00edn na b\u00e1ze spolo\u010dn\u00e9ho<br>programu pripraven\u00e9ho tromi nasleduj\u00facimi predsedn\u00edctvami na obdobie<br>18 mesiacov.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Hlasovanie kvalifikovanou v\u00e4\u010d\u0161inou<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Kvalifikovan\u00e1 v\u00e4\u010d\u0161ina<br>pri hlasovan\u00ed v Rade sa st\u00e1va v\u0161eobecn\u00fdm<br>pravidlom. Na vytvorenie blokuj\u00facej<br>men\u0161iny<br>je potrebn\u00fd minim\u00e1lny po\u010det 4 \u010dlensk\u00fdch \u0161t\u00e1tov \u2013 toto<br>ustanovenie nadobudne \u00fa\u010dinnos\u0165 a\u017e v roku 2014<br>. Bude sa na\u0148 tie\u017e<br>vz\u0165ahova\u0165 trojro\u010dn\u00e9 prechodn\u00e9 obdobie trvaj\u00face do roku 2017, po\u010das<br>ktor\u00e9ho bude mo\u017en\u00e9 na \u017eiados\u0165 niektor\u00e9ho \u010dlensk\u00e9ho \u0161t\u00e1tu rozhodova\u0165<br>e\u0161te v s\u00falade so star\u00fdmi hlasovac\u00edmi pravidlami stanoven\u00fdmi v Zmluve<br>z Nice. Staro-nov\u00fd mechanizmus vych\u00e1dzaj\u00faci z Ioaninsk\u00e9ho<br>kompromisu<br>okrem toho ustanovuje, \u017ee pred prijat\u00edm legislat\u00edvneho<br>n\u00e1vrhu m\u00f4\u017ee nespokojn\u00e1 skupina \u010dlensk\u00fdch \u0161t\u00e1tov, ktor\u00e1 je men\u0161ia ako<br>potrebn\u00e1 blokuj\u00faca men\u0161ina pod\u013ea ustanoven\u00ed zmluvy, po\u017eiada\u0165 o jeho<br>op\u00e4tovn\u00e9 pos\u00fadenie. V s\u00falade s vyhl\u00e1sen\u00edm pripojen\u00fdm k novej zmluve<br>bude ma\u0165 tento mechanizmus povahu rozhodnutia Rady \u2013 teda pr\u00e1vne<br>z\u00e1v\u00e4zn\u00e9ho aktu. V Protokole dohodnutom v z\u00e1vere\u010dn\u00fdch hodin\u00e1ch<br>rokovania medzivl\u00e1dnej konferencie sa uv\u00e1dza, \u017ee Rada m\u00f4\u017ee zru\u0161i\u0165<br>alebo zmeni\u0165 a doplni\u0165 toto rozhodnutie iba po predch\u00e1dzaj\u00facom<br>rokovan\u00ed Eur\u00f3pskej rady, ktor\u00e1 rozhodne na z\u00e1klade konsenzu.<br>Lisabonsk\u00e1 zmluva v\u00fdznamne roz\u0161iruje po\u010det pr\u00edpadov<br>(44), kedy<br>Rada bude m\u00f4c\u0165 rozhodova\u0165 kvalifikovanou v\u00e4\u010d\u0161inou: v 24 pr\u00edpadoch sa<br>tieto zmeny t\u00fdkaj\u00fa pr\u00e1vneho z\u00e1kladu, ktor\u00fd predpoklad\u00e1 pod\u013ea<br>s\u00fa\u010dasn\u00fdch zml\u00fav rozhodovanie na z\u00e1klade jednomyse\u013enosti,<br>predov\u0161etk\u00fdm ide o oblasti slobody, spravodlivosti a bezpe\u010dnosti (napr.<br>kontrola hran\u00edc, azylov\u00e9 ot\u00e1zky, imigr\u00e1cia); v oblasti SZBP v pr\u00edpadoch,<br>ke\u010f n\u00e1vrh predlo\u017eil Vysok\u00fd predstavite\u013e na z\u00e1klade \u017eiadosti ER.
